Recently, Canada immigration department had introduced changes to Canada immigration norms to ease obstacles in the way of renewal process of Canada work permits.
While the changes have been successful in weeding out widespread abuse in the system including bogus offers of jobs.
However, certain rules don’t seem gel well together leading to new set of problems. And this is true in case of renewal of Canada work permit.
Complications in renewal of Canada work permit–Canada work permit is a legal document granting right to any foreigner to work in Canada for a temporary period between two to three years. Renewal process for Canada work permit (WP) is somewhat vague unless the overseas worker enjoys certain exemptions.
As per current rules, renewal of Canada WP of any employee requires prior advertising for ensuring applications for the concerned job positions from Canadians or Canada permanent residents along with seeking LMO (Labor Market Opinion) from Service Canada.
Hence, majority of foreigners prefer to wait for the last moment of the expiry of their Canada work permits before seeking its renewal due to the above mentioned complexities.
Changes introduced by CIC (Citizenship and Immigration Canada) in the renewal process of Canada work permit have reduced processing times to just one month from the earlier three to four months.
Still, many foreigners are being robbed of the opportunity to work in Canada even though for a temporary period when any incomplete application for Canada WP(in case, renewal applications are not accompanied by approved LMO) are refused and the 60 day limit for expired Canada WP has also passed.
What’s the solution—This problem can be avoided by waiting for an LMO approval and then applying afresh for a new Canada WP along with a request for restoration of legal status of the employee for working in Canada.
Another thing worth consideration here is that one must begin work on renewal of Canada WP at least six to seven months before the expiry data of Canada WP to avoid any delays or denials later on.
